A joint petition was filed by both the parties whereby a sum of Rs.7,80,000/- was to be paid by the petitioner to the respondents and the same was received by the respondents on 4th July, 2023. The respondents have filed an affidavit stating to have received a sum of Rs.7,80,000/- as full and final settlement as mentioned in Para 1, 2 and 3 of the affidavit dated 17.8.2023. Let the said affidavit be kept on record.
In view of the provisions of Section 320 Cr.P.C. as well as Section 147 of the Negotiable Instrument Act the compromise petition between the parties as of full and final settlement is considered.
The order dated 16th August, 2016 passed by the C.J.M., South Andaman, Port Blair in C.R. Case No.54 of 2015 is set aside. The petitioner is accordingly set at liberty. The revisional application is accordingly disposed of. (Ananya Bandyopadhyay, J.)
