Governor and Others Mr. Mit Guha Roy [through virtual mode] Mr. Pardeshia Munda .... for the petitioner Ms. Babita Das ... for the respondent nos.1 to 3 Mr. Sumit Kumar Karmakar ... for the respondent nos.4&5 December 19, 2025 [SR] Item No. 3 Pursuant to the liberty granted the petitioner, the petitioner has filed a supplementary affidavit which is taken on record and copy of such supplementary affidavit has been duly served upon the learned Public Prosecutor and the learned Government Pleader representing the respondent authorities In the letter of complaint before the Station House Officer, Aberdeen Police Station dated July 12, 2025, the petitioner has prayed for registration of an FIR under appropriate sections of law including provisions of cheating, forgery and violation of court orders and also to invoke the provisions of SC/ST (Prevention of Atrocities) Act.
On a query of the Court as to whether the ingredients of cheating has been disclosed in the complaint, the learned advocate appearing for the petitioner prays for time. After going through the complaint, it prima facie appears to this Court that the petitioner has disputed the recording in
the revenue record. Accordingly to the petitioners there has been a wrong recording in the revenue records. After some arguments, the learned advocate appearing for the petitioner prays for withdrawal of this application with liberty to approach the concerned Jurisdictional Magistrate. The learned Public Prosecutor and the Government Pleader representing the respondent authorities are present. In view of the submission of the learned advocate for the petitioner, WPA/604/2025 stands dismissed as withdrawn with liberty as prayed for by the petitioner.
