Vijay Kumar .... for the petitioner Ms. Babita Das ... for the respondents December 18, 2025 [SR] Item No. 2 The petitioner submitted a complaint before the Sub Divisional Magistrate, South Andaman alleging that the private respondents have illegally damages the boundary wall constructed by the Andaman Public Works Department. The grievance of the petitioner is that no effective step has been taken by the concerned Sub Divisional Magistrate excepting registration of a case under section 152 of the Bharatiya Nagarik Surksha Sanhita, 2023.

Learned advocate appearing for the respondent authorities submits that, after initiation of the proceeding under section 152 of the BNSS, notices were issued to the parties and a date of hearing has also been fixed. She further submits that the proceeding is still pending. After hearing the learned advocates appearing for the respective parties, this Court is of the considered view that interest of justice would be subserved, if the Sub Divisional Magistrate is directed to dispose of the said proceeding expeditiously.

In the light of the submissions made by the learned advocates appearing for the respective parties, WPA/610/2025 stands disposed of by directing the Sub Divisional Magistrate, South Andaman being the second respondent to dispose of the case being No.165 of 2025 in accordance with law as expeditiously as possible but preferably within a period of eight weeks from the date of receipt of a server copy of this order. It is however made clear that this Court has not gone into the merits of the claim and counter claim of the respective parties and all points are left open to be decided by the Sub Divisional Magistrate, South Andaman.
