Respondents Mr. Pardeshia Munda ...for the Petitioner Mr. Tulsi Lall Mr. Rakesh Kumar ...for the Respondents August 16, 2023 (Bithika) Item No.24 The application under Article 226 of the Constitution of India has been filed being aggrieved for non provision of electricity supply. The Writ petitioner had filed an application before the respondent authority for supply of electricity on 06.04.2023 which was duly received by the respondent authority.

However, till date electricity connection was not provided to the house of the petitioner situated on the encroached Government Revenue Land as stated in the petition.

Heard the submissions of learned Advocates of both the parties.

In view of the observation of the larger Bench of the Hon'ble High Court at Calcutta in Abhimanyu Mazumdar Versus Superintending Engineer reported in 2011(2) CHN (Cal) 768, the respondent authority is directed to provide electricity connection to the petitioner within a

period of three weeks from the date of communication of this order upon due compliance of terms and conditions necessary for obtaining such electric connection being in possession of the premise for installation of electric meter without creating any proprietary interest upon the encroached property.

WPA No.860 of 2023 is disposed of.

The parties are to act upon the server copy of this order.
