The learned counsel for the petitioner submits that a direction may be given for expeditious disposal of the suit for specific performance. The applicant is a defendant. 2.

The applicant has disclosed the orders passed in the suit to show that the matter was adjourned from time to time. It appears that 19th April, 2023 was fixed. 3.

It appears that evidence of the plaintiff had commenced on 21st March, 2022 and is yet to be concluded.

Under such circumstances, this court directs the Joint Civil Judge (Senior Division), Port Blair (Incharge) to prepare a schedule for conducting of the trial of the suit and conclude the evidence of the witnesses preferably within a period of four months from the next date fixed for evidence.

This Court directs the Joint Civil Judge (Senior Division),Port Blair (incharge) to make all endeavour to dispose of the suit as expeditiously as possible without granting any adjournment to either of the parties unless it is unavoidable.

The civil revisional application is accordingly disposed of. There shall be no order as to costs. 7.

Urgent certified photostat copy of this order, if applied for, be supplied to the parties, upon compliance of usual formalities.
