The writ application has been preferred praying for direction upon the respondent authorities to provide new Water Tap connection in favour of the writ petitioner in his dwelling house standing in survey No. 159 measuring an of 40 sq. mtrs. situated at Babu Lane, Aberdeen Village within Sri Vijaya Puram Tehsil, District of South Andaman. 2.

The learned counsel appearing for the respondent authorities submits that the petitioner's application at page 11 shall be considered, but subject to meeting all the formalities, as required under the rules and regulations.

It appears that prima facie the petitioner is praying for the said connection which is admittedly on an encroached land and as such it is made clear that the water connection if given by the respondent authorities on completion of all formalities, shall not create any right in favour of the petitioner as to the title in respect of the land, which has been admittedly encroached.

Accordingly, the writ application is disposed of with the direction that the respondent authorities shall consider the

petitioner's application dated 19.09.2025 on giving a hearing to the petitioner and on the petitioner complying with all the formalities as required shall dispose of the same within thirty days from the date of communication of this order, considering the water is an essential requirement, by passing a reasoned order in accordance with law.

The writ petition is accordingly disposed of along with all connected application, if any.
