Mr. Terence D'Cruz ... for the petitioner Mr. Shatardru Chakraborty Mr. Ramendu Agarwal ... for the respondents December,14 2022 [SR] Item No.18 The petitioner claims that the sums of money admitted against the 5th and final bill for work done for construction of two class rooms and two toilets block in Government Primary School, Dasrathpur, North and Middle Andaman, has not been released till date. There is a letter addressed by the Executive Engineer, APWD, Rangat to the Chief Engineer, APWD, Nirman Bhawan, Port Blair, that the bill is payable. There are some accounting issues with regard to payment of 3rd and 4th R.A Bills.

In those circumstances, the Chief Engineer, APWD, Nirman Bhawan, Prot Blair shall take a decision in the matter of payment of 5th and final bill of the petitioner mandatorily and positively within a period three weeks

from the date of communication of this order. If found payable, the sum of money in 5th and final bill may be released to him within a period of three weeks thereafter. Any decision of the APWD shall be communicated to the petitioner immediately after three weeks as indicated hereinabove.

WPA/865/2022 stands disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
