The Andaman and Nicobar Administration and others Mr. KMB Jayapal ... for the petitioner Mr. Shatadru Chakraborty Mr. Dibesh Dwivedi ... for the respondents August 21, 2023 [SR] Item No.13 The petitioner claims to be in continuous service as Daily Rated Mazdoor since 1994. He seeks regularization. Repeated representations were made by the petitioner. The same are yet to be considered. The petitioner relies upon the order passed by the Labour Court with regard to his age at the time of initial engagement.

Without going into merit of the claim of the petitioner, as it appears that his representation seeking regularization is pending consideration at the end of the respondent authority, accordingly, the present writ petition is disposed of by directing the respondent no.4, Deputy Conservator of Forests to take a decision apropos the representation filed by the petitioner seeking regularization in accordance with law, at the earliest, but positively within a period of six weeks from the date of communication of this order. A reasoned order shall be passed and communicated to the petitioner immediately thereafter.

Learned advocate is directed to forward all documents in support his claim for regularization to the aforesaid respondent at the time of communicating the order of the Court.

It is made clear that this Court has not entered into the merit of the claim of the petitioner and all points are left open to be decided by the aforesaid respondent at the time of consideration of his representation.

The writ petition stands disposed of.
