The representation made by the petitioner seeking regularization of the encroached land is pending consideration at the end of the Deputy Commissioner, North and Middle Andaman District.

The petitioner claims to be the descendant of one Sher Mohammed, who encroached upon certain plots of land and the name of the encroacher is reflected in the Khasra register maintained by the authority.

Without entering into the merits of the prayer of the petitioner, the instant writ petition is disposed of by directing the Deputy Commissioner, North and Middle Andaman to consider the representation made by the petitioner in accordance with law after giving a reasonable opportunity of hearing to all the necessary parties and dispose of the same by passing a reasoned order at the earliest but positively within a period of eight weeks from the date of communication of this order. If required, the Deputy Commissioner may cause spot

inspection to ascertain the genuinity of the claim of the petitioner.

The writ petition is disposed of. There shall be no order as to costs.
