Respondents Ms. Kanchan Rai ... petitioner (in person) Ms. Anjili Nag ...for the respondents December 19, 2022 [SR] Item No.5 The Investigating Officer - Sub Inspector (Executive) of the Rangat Police Station, Middle Andaman has filed a report. It is submitted on the basis of the report that as many as 25 statements under section 161 of the Cr.P.C have been recorded. The call data records of the victim and the accused have been seized. The investigation has progressed substantially The petitioner appearing in person along with her son submits that the Post-Mortem Report of the hospital at Mayabunder and Rangat have not been considered by the Investigating Officer. It is also submitted that the victim might have been murdered since there is no suicide note. Counsel for the respondents submits that the Post Mortem Reports have been collected.
It is now well settled that in the event of any evidence of any further offence, other than that specified in the FIR having been committed by the accused, the Investigating
Officer has liberty to apply before the concerned Magistrate for adding additional sections in the FIR. He may do so, in the event, such need arises.
The Investigating Officer shall explore all and every possibility and leave no stone unturned in arriving at the truth behind the unfortunate death of the victim. It is ordered that the investigation be completed mandatorily and positively within a period one month from date. The final report be filed before the jurisdictional magistrate. A copy of such report be made available to the defacto complainant/writ petitioner. She may avail remedies inter alia under section 173 (8) of the Cr.P.C if so advised. WPA/878/2022 stands disposed of without any order as to costs.
