The said representation mentions about an application filed by the petitioner dated 25th July, 2018. The said application dated 25th July,2018 is not annexed to the writ petition.
Learned advocate for the petitioner categorically submits that he does not have a copy of the application dated 25th July, 2018.
It appears from the representation submitted before the respondent authority on 30th June, 2023 that certain allegations have been made against the Deputy Commissioner, South Andaman for not taken steps for disposal of the initial application filed by the petitioner on 25th July, 2018.
Learned advocate representing the respondent authorities submits, upon instruction that, the erstwhile Deputy Commissioner has since been transferred and the present Deputy Commissioner has taken steps for disposal of the application filed by the petitioner in July 2018. It has been submitted that 25th August, 2023 is the date fixed for hearing of the application. Efforts were taken to serve notice of hearing upon the petitioner intimating the date of hearing, but the petitioner has refused to accept the notice.
As it appears that the respondent authority is taking active steps for consideration of the representation filed by the petitioner on 25th July, 2018 and date has already been fixed for hearing of the said application, accordingly, the instant writ petition is disposed of by directing the Deputy Commissioner to consider the said application and dispose of the same in accordance with law after giving an opportunity of hearing to the petitioner within a period of six weeks from the date of communication of this order. A reasoned order shall be passed and communicated to the petitioner immediately thereafter.
The date of hearing is clearly mentioned in this order and it will be open for the petitioner to participate in the hearing scheduled on 25th August, 2023.
Learned advocate appearing on behalf of the petitioner submits that his client will be duly represented in the hearing to be held on 25th August, 2023.
The writ petition stands dispose of.
