Mishra ... for the Petitioner Mrs. Anjili Nag ...for the Respondents August 21, 2023 [M.A.Mobin] Item No.18 The learned Advocate for the petitioner seeks expeditious hearing of the application under Order 1 Rule 10 and the application filed under Order 22 Rule 10 read with Section 151 of the Civil Procedure Code. The learned Advocate for the respondents submits liberty be given to file an objection to the application filed under Order 22 Rule 10 as aforesaid.

Heard submissions of learned Advocates for both the parties and on perusal of the petition before this Court it appears that the respondent Bank i.e. the Indian Bank with which the Allahabad Bank has been merged has not been arraigned a party before the Ld. Trial Court. Necessary steps be taken with regard to such arraignment at the earliest on the basis of the application filed before the Ld.

Trial Court. The Ld. Trial Court is to act in accordance with the directions of this Hon'ble Court vide order dated August 25, 2022.

Both the parties seek for expeditious hearing of the aforesaid application.

Under such circumstances, the learned Trial Court is directed to prepone the next date of hearing from 11th September, 2023 to 6th September, 2023.

The Ld. Trial Court is further requested to dispose of the money suit being No.35 of 2019 within a period of one year without granting unnecessary adjournment to either of the parties.

Liberty be given to the respondent-Bank to file objection to the application under Order 22 Rule 10. CO 42 of 2023 is accordingly disposed of.
