Smti. Jasoda Mitra And ORS v. Shri. Nikunja Behari Mitra @ Nikunja Mitra And ORS.
IN THE HIGH COURT AT CALCUTTA
[ CIRCUIT BENCH AT PORT BLAIR ] *** CO/60/2024 Smt Jasoda Mitra and others Vs.
Shri Nikunja Behari Mitra @ Nikunja Mitra and others Ms. Anjili Nag, Sr. Adv.
Mr.Ajay Majhi ... for the petitioner/revisionist January 13, 2025 [SR] Item No.4 1.
Learned counsel for the revisionist submits that a direction be given for expediting the suit.
2.
The certified copies of order sheet of the suit have been annexed.
3.
It appears that on 16.01.2024, order was passed under Order 39 Rule 1 and 2. Thereafter, the defendant/revisionist filed an application under Order 39 Rule 4 of CPC. 4.
From the application of the revisionist, it appears that certain orders were passed by the Trial Court on 25.04.2024. Thereafter, it was adjourned for framing of issues on 20.08.2024.
5.
On 20.08.2024, counsels filed vakalatnama on behalf of the plaintiff, when the suit was fixed on 03.12.2024 for framing of issues. On 03.12.2024, the matter has again been adjourned for framing of issues to 24.02.2025.
6.
The order sheet does not reveal successive unnecessary adjournments having been taken on behalf of the plaintiff.
7.
This Court, however, would observes that since the framing of issues is fixed for 24.02.2025 and the parties are already in appearance, the Trial Court would proceed expeditiously in the matter without granting any undue adjournment and unnecessary delay.
8.
The revision stands disposed of.
