Mr. K.Vijay Kumar ... for the petitioner Mr. N.A.Khan ... for the respondent January 17, 2023 [SR] Item No.5 Liberty is granted to the learned advocate representing petitioner for making necessary correction in the cause title as well as in the prayer portion of the revisional application. A direction to secure expeditious disposal of the Misc. Execution Case No.55 of 2021 pending before the Court of learned Family Judge, at Port Blair, arising out of Misc.Case No. 116 of 2017, is ultimate relief sought to be obtained in this case.

Mr. N.A.Khan, learned advocate appearing for the opposite party submits that the opposite party-husband has already been placed on suspension.

The only contention expressed by the petitioner is against delay caused in disposal of the Misc. Execution Case No.55 of 2021. No other point is raised requiring address by this Court.

Since a simpliciter direction is proposed to be obtained for expeditious disposal of the referred Misc.Execution Case No.55 of 2021, the revisional application is disposed of by directing the Executing Court below to ensure expeditious disposal of the Misc. Exec. Case No.55 of 2021, subject to suitability and convenience of the Executing Court below, without granting unnecessary adjournment unless extremely unavoidable, preferably within twelve weeks from the date of communication of this order.

This order is passed without entering into the merits of the case and without prejudice to the rights and contention of the parties.

The point sought to be raised by the opposite party is left open for a decision by the Executing Court below. CO/34/2022 is thus disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court, pending application of certified copy upon compliance of formalities.
