Smt. Rajina Meri v. The Union Of India And ORS.
IN THE HIGH COURT AT CALCUTTA
[ CIRCUIT BENCH AT PORT BLAIR *** WP.CT/48/2023 Smt Rajina Meri Vs.
The Union of India and others Ms. Anjili Nag ... for the petitioner Mr. Dibesh Dwivedi ... for the administration September 21, 2023 [SR] Item No.8 The grievance of the writ petitioner in the instant writ petition is a delayed disposal of the tribunal application pending since 2018.
It is stated in the instant application that despite the directions having passed for exchange of affidavits, there was a reluctance shown by the Administration, in not filing the same which impedes the progress of the tribunal application. At the time of hearing, learned advocate for the petitioner submits that during the pendency of the instant writ petition, the reply to the tribunal application has been filed by the respondents. However, she submits that she will file the rejoinder within three days from date. Considering the period of pendency of the tribunal application and the fact that the Central Administrative Tribunal is holding the Circuit at the islands frequently, we expect that the matter which is pending since 2018, can be brought to its logical ends at the earliest.
The respondent/administration has filed the reply to the tribunal application and therefore, we direct the petitioner to file rejoinder to the same within three days from date. The tribunal is directed to prepone the matter and shall see that the tribunal application is heard and disposed of on or before 29th September, 2023, subject however to the rejoinder being filed by Monday (25.09.2023). With these observations, the writ petition is disposed of. No order as to costs.
Urgent Photostat certified copies of this order, if applied for, be made available to the parties subject to compliance with requisite formalities.
