Kumar ...for the Respondents October 10, 2023 (M.A.Mobin) Item No.18 The instant Writ application was filed by the petitioners against the concerned authority seeking specific direction on the ground that an application for mutation was preferred by the present petitioners on 17.11.2022 before the Tehsildar, Port Blair Tehsil. Thereafter, several reminders were made to the authority concerned, but the authority has not taken any appropriate step. So, the petitioners are before this Court for necessary direction. The respondents are represented.

Heard the learned Advocate for the respondents. Considering the entire matter the respondent no.2 i.e. the Tehsildar, Port Blair Tehsil, is directed to dispose of the application filed by the petitioners on 17th November, 2022 within December, 2023.

The authority shall dispose of the application after giving a reasonable opportunity to the petitioners of being heard.

After hearing the petitioners, the appropriate authority shall pass the necessary order according to the law. The order of the authority must be communicated to the petitioners within January, 2024.

Upon such direction the instant WPA 952 of 2023 is disposed of.

As the Affidavit-in-Opposition has not been used in this case so the allegation made in the Writ application is taken to be not admitted.
