[ CIRCUIT BENCH AT PORT BLAIR *** WPA/963/2023 Radhika Devi and another Vs The Sub Divisional Officer and Another Mr.Ananda Halder ... for the petitioners Mr. V.D.Sivabalan ... for the respondents October 11, 2023 [SR] Item No.9 The petitioners submitted an application dated 7th April, 2022 before the first respondent seeking permission to exchange the land occupied by each of them in terms of Regulation 154 of the Andaman and Nicobar Islands Land Revenue and Land Reforms Regulation, 1966. The said application is yet to be considered.

The petitioners pray for a direction upon the respondents to consider the application at the earliest. The learned counsel for the respondents submits that in considering the said application, a report has been called for from the Tehsildar, the second respondent herein, by the first respondent.

Upon consideration of the submission made on behalf of the parties, the writ petition is disposed of directing the first respondent to consider and dispose of the application dated 07.04.2022 submitted by the petitioners within a period of four weeks from date of communication of this order, upon affording reasonable opportunity of hearing to all concerned including the petitioners, in accordance with law. The

decision taken by the authorities shall be communicated to the petitioners within a week thereafter.

The writ petition being WPA/963/2023 is accordingly disposed of. There shall, however, be no order as to costs. Since affidavit has not been invited, the allegations made in the writ petition are deemed not to have been admitted.

Urgent photostat certified copy of this order, if applied for, may be supplied to the parties upon compliance of usual formalities.
