We have heard Mr. KMB Jayapal, learned counsel appearing for the petitioner and Mr. Salim Mohammed, learned Public Prosecutor on behalf of the State. 2.

The petitioner is the mother-in-law of the defacto complainant. The defacto complainant lodged a complaint with the Kharagpur Police Station regarding the physical and mental torture inflicted on her during her stay at Port Blair. The petitioner is one of the accused.

As rightly pointed out by the learned Public Prosecutor, the matter is still under investigation and no case has been filed as yet and accordingly the question of transferring the case does not arise.
