Kumar ...for the Respondents October 13, 2023 (M.A.Mobin) Item No.8 The learned Advocate for the petitioners has made a prayer before the Deputy Commissioner, South Andaman District, Port Blair on 17th January, 2023 to sub-divide a landed property on the basis of a final decree passed by a Court dated 05.12.2022. The respondent authority has not acted according to the prayer of the petitioners. Hence the petitioners are before this Writ Court. The respondent authority is represented.

Heard the learned Advocate for the respondent authority.

Considering the submissions of the parties the instant Writ Petition is disposed of with a direction that the respondent authority shall dispose of the petition filed by the present petitioners on 17th January, 2023 within

December, 2023 after awarding a reasonable opportunity of being heard to the petitioners.

The concerned authority shall arrive at a just decision according to the law and the prevalent Regulations in the Andaman & Nicobar Islands. The authority must inform the reasoned decision to the petitioners within a fortnight after such decision.

WPA 971 of 2023 is disposed of.

As the affidavits are not exchanged thus the allegation made in the petition shall deem to have been not admitted. The authority shall take independent decision in the matter without being influenced by any observation made by this Court.
