Respondents Mr. Pardeshia Munda ... for the petitioner Mr. Tulsi Lall Mr. Rakesh Kumar ...for the respondents January 18, 2023 [MAM] Item No.3 By instituting this Writ Petition the petitioner has voiced her grievance of not getting supply of drinking water to her residence from the concerned respondent authority. The petitioner meanwhile has approached the concerned Assistant Engineer, being the respondent no.3, by preferring application dated 7th November, 2022 whereby the said respondent no.3 was requested to take necessary steps for providing water connection at the residence of the petitioner. It has further been submitted that till date no steps have been taken by the said respondent no.3 in order to redress the grievance of the petitioner by providing water supply to the premises of the petitioner.

Lall, learned Advocate representing the respondents, submits that for providing supply of drinking water to the residence of the petitioner the authority is required to find out whether availability of infrastructure is

there which may permit the respondent no.3 to take steps for supply of water as prayed for.

Having considered the submissions made on behalf of the parties, this Court directs the respondent no.3 to take decision on the application of the petitioner dated 7th November, 2022 within a period of eight weeks from the date of communication of this order. Such decision to be communicated within a period of one week to the petitioner. However, it is made clear, if the respondent no.3 finds that similarly circumstanced other residents of the locality where the petitioner resides are getting water supply the prayer of the petitioner shall not be rejected on technical ground.

With the aforesaid direction the writ petition stands disposed of.

There shall be no order as to costs.
