He has also moved the tribunal (OA/840/2023) against the same order and complains that the tribunal is not admitting the application.

Learned counsel for the petitioner tries to justify the original application filed before the tribunal on the ground that the Appellate Authority has not been able to dispose of the appeal in six months. Hence, such right is available to him under section 20(2)(b) read with section 19(3) of the Administrative Tribunal Act, 1985.

We dispose of this application by directing that the tribunal shall consider admission and hearing of the original application in accordance with law within three months from the date of communication of this order.
