The State Mr. D.Ilango ... for the petitioners Ms. A.S.Zinu ... for the State December 18, 2023 [SR] Item No.5 According to the statement made in evidence by the victim, she was in a live in relationship with one Ravi Das and that the child which was subsequently born is through him. But Ms. A.S.Zinu learned advocate appearing for the prosecution submits that Ravi Das does not live in these islands but in Kolkata, could not be apprehended and is not charge sheeted for lack of identification.

The victim and her father being the principal witnesses have turned hostile.

The trial is in progress. The prosecution has 27 witnesses.

In the above facts and circumstances, we do not think that custodial trial of the petitioners is required. In those circumstances, we direct that each of the accused petitioners be released on bail upon furnishing of two registered sureties of Rs.10000/- each to the satisfaction of the Chief Judicial Magistrate, Mayabunder. They shall not

leave these islands without the prior permission of the concerned Court. The petitioners shall surrender their passports with the concerned Police Station.

The application for bail is accordingly disposed of on the above terms.
