The District and Sessions Judge Mr. Gopala Binnu Kumar .... for the petitioners Mr. Maheshwar Lall ... for the respondents January 17, 2024 [SR] Item No.9 Perused the affidavit filed by the learned District Judge, Andaman and Nicobar Islands, Port Blair. It has been fairly stated that the grievance of the writ petitioners are genuine and they are entitled to the reliefs claimed in the writ petition. Due to inadvertence, the file was not placed before the learned District Judge. On account of such lapse, proper scrutiny could not be made, for consideration of the issue. The relevant paragraphs of the said affidavit are 4 to 7 and 12. It has been stated that the grievance of the petitioners will be addressed and the petitioners will be granted their dues and entitlement within a short period.

In view of such approach of the learned District Judge, nothing further remains to be decided in the writ petition. Accordingly, let necessary orders be passed in terms of the affidavit filed by the learned District Judge and prayer (A) of the writ petition. Such decision shall be taken and communicated to the petitioners within a period of six weeks from the date of communication of this order. It is made clear that the benefits shall be given from the date when such benefits were given to similarly situated persons.

The writ petition is accordingly disposed of on the above terms.
