A suit was filed by land owners against the tenant seeking eviction of the ground of bonafide requirement as also for arrears of rent.

The tenant also filed a separate suit seeking declaration and injunction against the land owners restraining them from disturbing his peaceful possession over the tenanted premises. The suit filed by the landlord came to be dismissed, while the suit filed by tenant came to be decreed.

The landlord rushed to the learned First Appellate Court i.e. the learned District Court against the decrees passed against him. The learned District Judge although refused the decree on arrears of rent observing that no valid notice was

907-cra-51-2024 given by the landlord, yet the decree of eviction came to be passed observing that the plaintiff could prove the bonafide requirement of the tenanted premises. It is as against this, the tenant is in this Court.
