This Interim Application seeks withdrawal of the amount deposited by the Defendant with the Prothonotary & Senior Master vide praecipe dated 8th August 2007.

Mr. Dharra, learned Counsel, appears for the Applicant and submits that this Court may permit withdrawal in execution of decree dated 12th September 2005.

Mr. Parekh, learned Counsel, appears for the Respondent and submits that he has instructions to state that his client has no objection Kanchan Dhuri 1/2

13-IA-3470-2025.doc if the amount of Rs.2.50,000/- deposited on behalf of the Defendant in the Suit alongwith accrued interest is allowed to be withdrawn by the Applicant.

Having heard the learned Counsel and having considered their submissions, this Court is of the view that upon an application made in this behalf, the Prothonotary & Senior Master to make payment of Rs.2,50,000/- to the Applicant alongwith the accrued interest after due verification.

The Interim Application accordingly stands allowed and disposed as above.

The learned Counsel submit that in view of the disposal of the Interim Application, the Execution Application also be disposed. 7.
