It is very worrisome state of affairs that the proceedings are registered as a Revision Application in the year 2015 and they are pending for almost 9 years. No one including the Office has verified whether the order passed by the Court under the Maharashtra Protection of Depositors (In Financial Establishments) Act, 1999 ["MPID Act"] can be challenged by way of Revision. Section 11 of MPID Act provides a remedy of an Appeal against any order passed by the MPID Court. This issue was brought to the notice of learned Advocate for the Applicant on 19th January, 2024. Today, learned Advocate for Applicant submitted that she had also verified the provisions of MPID Act and she prayed for conversion of this Revision Application into an Appeal.

Be that it may, liberty has to be granted. Hence, following order :-

O R D E R

(a) Liberty granted to Applicant to convert this Revision Application into an Appeal and to make all necessary amendments within two weeks.

(b) Office to register it as an Appeal.

(c) Office to place it before Appropriate Bench.

On 16th December, 2015, the impugned order was stayed till next date. It was continued from time to time, let it be continued till four weeks. Let Applicant to seek circulation before the Appropriate Court within a period of four weeks.

If circulation is not sought, the continuation of the stay will stand vacate automatically.
