This Company Application seeks substitution of the Applicant in view of issuance of the Fresh Certificate of Incorporation in view of the scheme sanctioned by the Bombay High Court, Goa Bench and the Madras High Court vide orders dated 3rd April 2013 and 25th July 2013, pursuant to which the Applicant had merged with Sesa Goa Limited. avk 1/2 ARTI VILAS KHATATE by ARTI VILAS KHATATE Date: 2024.04.13 13:55:20 +0530

MrKhare, learned Counsel, appears for the Applicant and submits that since the Application for amendment is pursuant to a scheme sanctioned by the High Courts and pursuant to issuance of the Fresh Certificate of incorporation, this Court grant the Application. 3.

Having heard the learned Counsel and having perused the affidavit in support of the Application, this Court is of the view that the Application be allowed in terms of Prayer clause (a) which reads thus : "(a) That this Hon'ble Court be pleased to allow the Applicant to amend the present Company Application, Company Petition and all other papers and proceedings connected with the Company Application as per Schedule annexed hereto."

Let the amendment be carried out as per the Schedule within a period of two weeks and the amended Application be served upon the other parties within a period of two weeks thereafter and an affidavit of service be filed by the next date.

The Application is, accordingly, allowed and stands disposed. COMPANY APPLICATION NO.771 OF 2008 6.
