Civil Application No. 1928 of 2016 is filed for condonation of delay of 1 year and 27 days in filing First Appeal. Issue notice to the respondents, returnable in six weeks.

Learned counsel for the applicant­insurance Company submits that the execution proceedings are filed against the insurance Company, however, the insurance Company has deposited the entire decretal amount alongwith interest accrued thereon and, therefore, the judgment and order dated 07.08.2014 passed by the learned Judge, Commissioner for Employees Compensation and Judge 10th Labour Court, Mumbai be stayed.

The entire amount of compensation i.e. Rs. 2,32,455/­ alongwith interest accrued thereon has been deposited by the applicant­insurance Company by cheque dated 26.02.2015 and, therefore, the operation and execution of the impugned judgment and order dated 07.08.2014 is stayed, pending the appeal.
