Respondent No.7 is the owner of the offending vehicle. He was served by substitute service in a delay condonation application. He has not appeared.

The only issue involved in this appeal is whether the insurance policy has come into effect. It is for the simple reason that the cheque for the first premium got dishonored and second cheque also got dishonored. There is pay and recovery order passed by the Tribunal. The company is aggrieved. They want total exoneration.
