By this Petition, the Petitioner seeks quashing and setting aside of the impugned order dated 18th October, 2019 passed by the Respondent - Municipal Corporation of Greater, Mumbai with a further direction to the Respondent to change the name of Petitioner's parents in the birth certificate issued on 3rd July, 2019, thereby correcting the father's name from Anthony Ignatius Pereira to Antonio Inacio Pereira, and mother's name 1/3

from Josephine Pereira to Josefina Perpetua Anunciacao Pereira. 2.

From a perusal of the impugned order dated 18th October, 2019, it appears that the said application/ representation made by the Petitioner was rejected on the ground of delay in making the application, and on the ground that there was no mistake in the names. In fact, the Petitioner had relied on several documents, which are annexed to the Petition to show the correct names of his parents' of which he was seeking change of name in the birth certificate.

Mr.Mali, learned counsel appearing for the Respondent - Municipal Corporation, on instructions states that the Municipal Corporation is ready to reconsider a fresh application / representation, if made by the Petitioner, seeking the very same relief. Statement accepted.

At this stage, learned counsel for the Petitioner states that he will make an application, seeking the very same relief, as sought for in the present Petition, and as made earlier, within one 2/3

week from today to the Respondent - Municipal Corporations. If such an application / representation is made, the the Respondent - Municipal Corporation to decide the said application / representation within four weeks from the date of receipt of the said application / representation, uninfluenced by its earlier order dated 18th October, 2019. The Respondent to keep in mind the documents annexed by the Petitioner to this Petition and after verification of the said documents, to pass an appropriate order. 5.

The Petition is disposed of on the aforesaid terms. 6.

List the matter after six weeks for recording compliance.

All parties to act on the authenticated copy of this order.
