...Respondent
------ Mr. Pareshtar Parakha for Petitioners.
Mr. Kanhaiya S. Yadav, Mr. Paras Jadhav for Respondent. ------ CORAM : SHARMILA U. DESHMUKH, J.
DATE : FEBRUARY 5, 2026 P. C. :
1.
Learned counsel appearing for Petitioner submits that original Petitioner in the Testamentary Petition has suppressed the fact of the execution of Will by the deceased on 7th February, 1997 and has obtained letters of administration.
2.
Learned counsel appearing for Respondent submits that the Will does not bear the signature of the deceased. Upon query by this Court, learned counsel for the Petitioner submits that the draft Will was served upon learned counsel for original Petitioner. There appears to be cloud over the genuineness of such document considering that the Sairaj 1 of
902 MPT-394-2024.doc copy which is served by Respondent has not been executed by the deceased.
3.
Let Affidavit-in-reply be filed by the original PetitionerRespondent herein on or before 11th February, 2026. 4.
