In the present Writ Petition filed under Article 226 of the Constitution of India, the Petitioner is challenging the legality and validity of the Order dated 01.11.2018 passed by the Hon'ble Revenue Minister in Appeal-2616/Pra.Kra. 19/J-3.

Mr. Rodrigues, learned counsel for the Petitioner - U0I states that although there are various grounds on which the impugned Order is challenged, however, one of the grounds is that the impugned Order has been passed without taking into consideration several documents submitted before the Hon'ble Revenue Minister by the Petitioner - UOI. He states that a compilation of documents consisting of 32 documents has been submitted in the proceeding, however, none of the documents Anand Page No. 1

33. WP 1220-2024.doc are considered by the Hon'ble Revenue Minister. 3.

A perusal of the impugned order shows that many documents produced by the Petitioner are not considered. 4.

Accordingly, the impugned Order dated 01.11.2018 passed by the Hon'ble Revenue Minister in Appeal-2616/Pra.Kra. 19/J-3 is hereby quashed & set aside and the matter is remitted to the Hon'ble Revenue Minister.

It is clarified that this Court has not considered the merits and all the contentions on merits are expressly kept open. 6.

In view of disposal of the Writ Petition, the I. A. (L) No. 7188 of 2021 does not survive and the same stands disposed of accordingly. [MADHAV J. JAMDAR, J.] Anand Page No. 2
