Heard Mr. Shete, learned Advocate for Petitioners; Mr. Alaspurkar, learned AGP for Respondent Nos. 1 to 3 - State and Mr. Chavan, learned Advocate for Respondent Nos. 4 to 31. 2.

The order impugned in the present Petition is an appellable order passed by SDO under Schedule E read with Section 257 of the Maharashtra Land Revenue Code, 1966. Though the Petition is filed in 2021 and has remained pending since then prima facie it is seen that on 18.03.2021 this Court passed ad-interim order. 3.

This Court cannot be a Court of fact and give its imprimatur when there is a hierarchy of at least 3 Statutory Appellate / Revision

25. CIVIL WP-60-2026.odt Authorities in between. In that view of the matter, Writ Petition stands disposed with the following order:- 3.1.

Petitioners are directed to file Statutory Appeal before the next Appellate Authority against the impugned order as available to the Petitioners in law which shall be filed within a period of three weeks from today alongwith Stay Application. Time spent in prosecuting this Writ Petition stands dispensed with.

3.2.

For the next three weeks and for a further period of four weeks thereafter, order dated 18.03.2021 shall stand continued to protect the Petitioners before me.

3.3.

Needless to state that Stay Application and Appeal shall be considered by the Appellate Authority and it shall pass appropriate orders therein after hearing the concerned parties. 3.4.

All contentions of the parties are kept open. 4.
