Heard Mr Arjunwadkar for the Petitioner and Mr Abhijit Kulkarni for the 1st Respondent.

The Petitioner seeks a directions to the 1st Respondent to dispose of the Petitioner's applications dated 20 November 2009 and 1 December 2009 seeking modification of the Town Planning Scheme within some reasonable period.

Mr Arjunwadkar points out that based on the Petitioner's representations, report was called from the Kolhapur Municipal Corporation (Respondent No.2), He points out that such report was submitted by the Corporation on 19 July 2010. Considering the limited grievance made, we direct the 1st Respondent to dispose of the Petitioner's representations dated 20 November 2009 and 1 December 2009 in accordance with law as expeditiously as possible and in any event within four months from today.

The 1st Respondent, i.e., the Secretary, Department of Urban Development must hear the Petitioner and Respondent Nos. 4 to 9 and pass a reasoned order which should be communicated to all the parties within a period of four months.

If any of the parties are aggrieved by the decision so communicated, they shall have liberty to challenge the same in accordance with law.

The Petition is disposed of in the above terms without any order for costs.

All concerned to act on an authenticated copy of this order. 9.

The Petitioner must serve a copy of this order on Respondent Nos. 4 to 9 within a week from today.
