The challenge in this petition is to an order dated 9th March 2021, whereby the learned Judge, City Civil Court was persuaded to condone the delay and restore the suit to file, which was dismissed in default. Though the petition was filed in the year 2021, the petitioner did not take steps to get the petition listed, and the petition is coming before the Court for the first time today.

In these circumstances, there is no propriety in entertaining the petition at this length of time when the trial in the suit has progressed.

The petition stands disposed.
