Learned counsel for the appellant submits that as no claim was lodged by the Employees State Insurance Corporation before the Resolution Professional, the claim of the Corporation has lapsed. He submits that subsequently resolution plan has been approved by NCLT. 2.

Learned counsel for the appellant on instructions seeks permission to withdraw the appeal. Appeal is disposed of as withdrawn. Needless to clarify that as the appeal is withdrawn all rights and contentions of the parties are expressly kept open. In view of disposal of petition, Interim/Civil Applications, if any, do not survive for consideration and stand disposed of.
