Learned Counsel Mr.Pavse for the Appellant No.1/Shahadeo and learned Counsel for Respondent No.2/insurance company tender on record settlement arrived at between the parties. It is marked as Exhibit-X. They pray for disposing of the first appeal in view of the settlement.

With the assistance of learned counsels I have ascertained the identification of the appellant no.1/Shahadeo who is present today. He reiterates that appeal should be disposed of as per the compromise. The letter dated 12.06.2025 addressed by Legal Manager of respondent/insurance company shows that has agreed for full and final settlement by paying additional Rs.2,00,000/- 3.

Learned counsel Mr.Shah for the insurance company submits that amount of Rs.2,00,000/- would be paid to the

2 920.FA-2213-2024.doc appellants within period of two weeks by crediting in the accounts. 4.

I find that there is no legal impediment in disposing of first appeal. Though appellant no.2 is a minor, he is staying with the appellant no.1 and his interest is taken care of. 5.

First appeal is disposed of in terms of the compromise which is at Exhibit-X. Compromise which is at Exhibit-X shall be part of the decree.

Respondent No.2/insurance company shall pay additional amount of Rs.2,00,000/- within one (01) week from today to appellants.

7.

Decree be drawn accordingly.
