This application is for bringing on record the names of heirs and legal representatives of deceased appellant no.2. 2.

In the facts and circumstances of the case, delay is condoned and the application is allowed in terms of prayer clauses (b) and (c).

Amendment to be carried out within four weeks. 4.

Learned counsel for the parties on instructions submit that they are agreeable to explore the possibility of an amicable Page no. 2 of 3

settlement through mediation. They submit that Mr. Guru Prasad Malkar, has agreed to mediate. They submit that the mediation meetings shall be held at Kolhapur.

5.

By consent, Mr Guru Prasad Malkar, Advocate is appointed as Mediator.

6.

Learned Mediator is at liberty to issue necessary directions for payment of mediation charges if any. The mediation charges if any, shall be paid by the parties equally.

7.

Learned advocate for the appellants shall intimate this order to the learned Mediator for further process.

8.

Soft copy of this order to be directly shared to the Main Mediation Centre, High Court, Bombay, at the time of uploading. 9.

The intervenor is also permitted to participate in the mediation process.
