This appeal is filed by the Appellant under Section 374 of the Code of Criminal Procedure, challenging the judgment and order dated 20.09.2021 passed by the learned Sessions Judge, Panaji in Special Criminal Case (NDPS) No. 7/2015, convicting the Appellant under Section 22(c) of the NDPS Act. The Appellant was arrested on 05.09.2024 and was granted bail by the Trial Court on 13.02.2017. Thereafter, this Court also granted bail by order dated 22.12.2021; however, the Appellant could not avail of the said bail as he failed to comply with the conditions imposed.

2. It is noted that the Appellant has already undergone the sentence imposed by the Sessions Court and was accordingly released from jail 20th November, 2025

CRIA 48 of 2024 on 19.08.2024. When the matter was listed for final hearing today, learned Counsel for the Appellant sought leave to withdraw the appeal on the ground that the Appellant has already served the sentence awarded and stands released.

3. In view of the above circumstances, permission is granted to the Appellant to withdraw the appeal. The appeal accordingly stands disposed of as withdrawn. All pending applications, if any, also stand disposed of.
