The Interim Application seeks amendment to bring on record the legal heirs of Defendant No.1 who has passed away during the pendency of the present Suit. Learned counsel appearing on behalf of Defendant No.2 has submitted that he does not have any objection to the Interim Application being allowed, insofar as he seeks to bring on record the legal heirs of Defendant No.1 who has passed away. He however invites my attention to the schedule of amendment and points out that the same also provide that the name of Plaintiff Kiran Kawre

Learned counsel appearing on behalf of the applicant has clarified that the amendment is sought only qua impleading the names of the proposed defendants 1 (a) Mrs. Nisha Nanda Kumar & 1(b) Ms. Krupa Nanda Kumar and is not pressing for amendment in terms of correcting the name of plaintiff No.2.

Accepting her statement, Interim Application is allowed in the aforesaid terms.
