This application is taken out by original defendant for necessary orders to sell the cars which are subject matter of the present suit.

Both the counsel state that it is in the interest of both the parties that this vehicles are sold at the earliest. The only difference of opinion between them is the appointment of the agency who will be engaged for sale of this car.

After hearing both the parties, I am of the view that the agency by the name of "Mahindra First Choice Wheels" can be approached by the applicant-defendant for necessary further action for sale of the vehicles. The plaintiff should cooperate in letter and spirit for
Sayyed 15-IA.5923.2025.doc the sale of vehicles so that the transaction of sale can be concluded at best price at the earliest.

Once the vehicles are sold, the concerned agency to issue demand draft in favour of the "Prothonotary and Senior Master" of Bombay High Court by giving reference and the details of the present Commercial Suit. Such sale proceeds received by the Prothonotary to be deposited in a nationalised bank in a fixed deposit. 5.
The Interim Application is disposed of.
