When this matter was called out, the learned counsel appearing for the respondent states that nothing survives in the present application for the reason that the Transfer Application no.1 of 2021 filed by the respondent-wife for transfer of the proceeding initiated by the applicant from the Court of Bandra to the Court of Vasco-da-Gama, Goa has already been allowed by order dated 29.6.2021 passed by this Court. 2.

Be that as it may, the office note shows that when the present transfer application filed by the husband was transferred from the Principal Seat at Bombay to this Court at Goa, notice was issued to the parties. The office note shows that the respondent(wife) was served but service report on the 4th October 2021

34-MCA-1843-2021(F).DOC applicant(husband) in this application is still awaited. It would be in the fitness of things that this application is disposed of after notice is served on the husband.

In the peculiar circumstances, the office is directed to issue fresh notice to the applicant in this case returnable on 26.10.2021.
