During the course of arguments, it has come to light that the Applicant was also proceeded against for offences under the NDPS Act in another matter which is stated to be of the year 2009 and it pertains to case bearing no. NDPS/4/2011 before the Court of Additional Sessions Judge, Mapusa.

It is stated that the passport of the Applicant was attached in the said case before the aforesaid Court. A photo copy of the first page of the said passport is annexed as annexure E to the present application. It appears that the Applicant does not have a valid passport in his name. In such a situation, it would be inappropriate to enlarge the Applicant on bail during the pendency of the appeal, unless the Applicant either produces an original valid passport before this Court or takes steps to apply for the same.
