This is yet one more case wherein the Education Officer (Secondary), Zilla Parishad, Sangli, Shri Vishnu Kamble, has raised objections/deficiences while entertaining the proposal for approval forwarded by the Management. The deficiencies were pointed out to the Management vide the impugned communication dated 29th April, 2022 and yet, the Education Officer has rejected the proposal. 2.

Time and again, we have quashed and set aside hundreds of such type of orders. We have cautioned the Education Officers that Ingale

24-wp-2236-25.odt they should not reject the proposals. If deficiencies are noticed, an opportunity may be granted to the Management to remove the deficiencies and submit a revised proposal.

In view of the above, this Petition is partly allowed. The impugned order dated 29th April, 2022 is quashed and set aside and the deficiencies mentioned therein would be treated as a notice to the Management to remove the said deficiencies and submit a proposal, complete in all respects, within a period of 45 days. 4.

The said Education Officer, would receive the revised proposal and by applying the law and the policies, shall conduct a meticulous verification exercise and pass an order within a period of 45 days from the date of receipt of the proposal. We clarify that the law and the policies as were applicable on the date of the appointment of the Petitioner, would be made applicable. If the Education Officer passes an adverse order, the same shall contain reasons. 5.

The Writ Petition is disposed off.
