The captioned Petitions essentially impugn decisions taken in the disciplinary proceedings.

The record shows the charges that have been levelled and detailed replies were filed by the respective Petitioners. However, the order passed by the Chief Executive, who is a Disciplinary Authority, Digitally signed by AARTI GAJANAN PALKAR Date:

36.WP.2313.2024.doc contains no analysis whatsoever of the submissions on the issues involved. Indeed, the order passed by the Divisional Commissioner is equally devoid of reasons. The first order simply answer the charges framed, on a Yes/No basis even in respect of the charges where the Petitioners are exonerated. There is no analysis whatsoever in either order.

Therefore, there is no option but to quash and set aside the impugned orders for being devoid of any reasons and thereby being contrary to law.

The Petitions are allowed in the aforesaid terms. The Impugned Orders are quashed and set aside.

Both the Petition are hereby finally disposed of. 6.

All actions required to be taken pursuant to this order shall be taken upon receipt of a downloaded copy as available on this Court's website.
