Heard Mr. Yeramwar, learned Counsel for the petitioner. 2.

The petitioner has put forth following prayers; "(a) to call for record and proceedings from the respondents;

(b) to issue a Writ of Mandamus or any other writ, order or direction in the like nature and to direct the respondent no.2 to allow the petitioner to join services as Junior Clerk with the establishment of respondent no.2;

(c) to allow, during the pendency of the petition, the petitioner to join establishment of Respondent No. 2 as a SHAILAJA SHRIKANT HALKUDE SHAILAJA SHRIKANT HALKUDE Date: 2026.01.29 10:37:43 +0530

51-WP-2384-2024.doc Junior Clerk and to direct the respondents to pay the salary and other consequential benefits to the petitioner regularly;

(d) to grant ad-interim and interim reliefs in terms of prayer clause (c) above;

(e) to provide for costs of this petition;

(f) to pass any such other and further orders as this Hon'ble Court deems fit and proper in facts and circumstances of the case".

From the recitals of the pleadings and prayer clauses, we find that the petitioner has efficacious alternate remedy available under the Administrative Tribunals Act.

In view of the above, the petition stands disposed of, with liberty to the petitioner to avail of appropriate legal remedies, as may be available in law, before the Maharashtra Administrative Tribunal. Time spent in prosecuting the writ petition shall be considered by the learned Maharashtra Administrative Tribunal.

All contentions are kept open.
