The commissioner has refused to condone the delay relying on Section 257(C)(1) of the Land Revenue Code, 1966 (for short 'the said Code'). Such restrictions is applicable only if powers under Section 257 of the said Code are exercised by the Officer below rank of Commissioner. In the facts of the case, the proceedings arises out of Section 149 which have been confirmed by the Sub-Divisional Officer and the Collector and, therefore, the power of the Commissioner under Section 257 of the said Code was invoked. Hence, issue notice to respondents, returnable on 24 April 2024.
