The petitioner is seeking relief against Special Recovery Officer and a society not to recover maintenance in furtherance of certificate issued under Section 101 of the Maharashtra Cooperative Societies Act, 1960.

This is a novel attempt to get over certificates issued by the Registrar. If the petitioner is aggrieved by issuance of certificate or any precipitative action initiated by the Special Recovery Officer under Rule 107 of the Maharashtra Cooperative Societies Rules, 1961, proper remedy for the petitioner is as provided under the Act, and Rules. It is open for the petitioner to adopt appropriate proceedings as are permissible in law. However, the writ petition seeking such relief cannot be entertained.

Hence, keeping all questions raised in this writ petition open to be agitated in an appropriate proceedings, the writ petition stands disposed of. No costs.
