According to the petitioner, certificate under section 32M of the Maharashtra Tenancy and Agricultural Lands Act, 1948 was issued exclusively in the name of the petitioner. If this be so, the authorities in exercise of power under section 149 of the Maharashtra Land Revenue Code, 1966 could not have entered into exercise of adjudicating rights of the parties inter se. The remedy for aggrieved person was either to approach the Civil Court or file appeal under section 70 for adjudication of his rights. 3.

Hence, issue notice to the respondents, returnable on 12 August 2024.
