In this Public Interest Litigation, the petitioner has assailed the validity of Section 2(1-A) of the Maharashtra Motor Vehicle Tax Act, 1958.

In response to a query, the learned counsel for the petitioner submits that petitioner is not an aggrieved person. It is well settled in law that validity of the statutory provisions can only be challenged by a person who is aggrieved. The petitioner is, admittedly, not an aggrieved person. Therefore, the PIL at the instance of the petitioner, in which validity of statutory provisions has been challenged, cannot be entertained.

The PIL is, therefore, dismissed. However, issue with regard to validity of the statutory provisions involved in the instant PIL is kept open to be agitated in an appropriate proceedings.
